An act to reform broadcasting at a federal level in Banduria.
BE IT THEREFORE ENACTED, as follows:
§1 - Creation of a Federal Broadcasting Commission
- A Federal Broadcasting Commission shall be created, consisting of a non-partisan Board of Commissioners who will be selected by experience and reputation.
- The duties of the Federal Broadcasting Commission, henceforth referred to as the FBC, are as such;
- To ensure fair and balanced broadcasting in Banduria.
- To quell the influence of political parties and foreign powers on Bandurian airwaves.
- To ensure all entertainment programming consumed by children is wholesome and not damaging.
- To issue licences for all forms of broadcasting that will be accessed by the public, including television and radio broadcasting.
- Conditions for FBC licensure.
- Any corporation seeking an FBC licence must be at least 50% Bandurian owned.
- Content broadcast before 9 PM is subject to FBC scrutiny over language and content, and extremely offensive content broadcasted after the 9 PM "watershed" is also subject to FBC scrutiny, provided a petition.
- Corporations seeking a licence must not be tied to any political party or organisation.
- Petitions system.
- Any petition over offensive or otherwise in violation content with over 50,000 signatures will be sent to the FBC and reviewed.
- Petitions written by the House of Representatives with a majority vote in approval will be sent to the FBC and reviewed.
- Petitioners must explain the reason for the petition and why they find the content broadcast objectional.
§2 - Ban on misleading advertising.
- Any advertising that is found to mislead, misinform, harass, or cause offence to the general public is subject to FBC scrutiny.
- "Misleading advertising" includes but is not limited to: paid product placement without disclosure, false advertising, or violation of other FBC rules contained with advertising.
§3 - Ban on political advertising and political involvement in broadcasting..
- All advertising of a political nature is henceforth upon the passing of this act is banned, without exemption.
- No political party or group is allowed to broadcast any form of advertising, even non-political.
- Parties will be given a set timeslot to broadcast a "party political broadcast" during election season. The contents of these broadcasts must be civilised, must not mention any other political parties or organisations, must not mention politicians who are not a member of the party who created the broadcast, and must be kept to a length no longer than 20 minutes. Networks are forbidden from airing advertisements of any sort during party political broadcasts.
- Political organisations may, under absolutely no circumstances, influence programming of any sort aside from party political broadcasts.
- Newscasts must not take any political stance under any circumstance. Newscasts are restricted to broadcasting the news in a completely objective and unbiased manner, be they on the radio or on the television.
- Television and radio broadcasters found to be in violation of these rules are subject to immediate suspension and possible cessation of licensure with an appeals process.
